Salum Ally Salum vs The Republic, criminal appeal No 09 of 2021.

This case among other things provide the circumstancial and doctrine of recent Possession evidence may prove guilty of an accused person. As court had this to say:

“In the instant case, we are satisfied that the appellant’s conduct o f running away just after he

saw PW1 and PW3, is related to his guiltyconscience to the act he committed to PW1. Such

conduct is inconsistent with innocence.

“In the circumstances, and having revisited the entire evidence on record, we are satisfied that the first appellate court adequately reevaluated the evidence on record and arrived at a concurrent finding

with the trial court that the prosecution had managed to prove the case against the appellant beyond reasonable doubts. We thus equally find the nineth ground of appeal with no merit.
