Lucas Gisland vs The Republic,Criminal appeals, No 89 of 2021.

This case provide a remedy ro a party who had prayed before hearing the he to have time to look for advocate and Magistrate denying it and proceed with hearing.

The issue which arises is whether

not being accorded an opportunity to engage an advocate, did prejudice
the rights of the appellant in the circumstances of this case.
Upon scrutiny of the record, leaves us without doubt that, denial of opportunity for legal representation was prejudicial to the appellant’s rights.

The fact that legal representation is an essential component of a
fair trial has been over emphasized in various decisions of this Court as already discussed above. For the foregoing, plainly the appellant was denied a fair trial. Court ordered retrial.
