Kabula Azaria Ng’ondi &3 others, vs Maria Fransis Zumba Msolopa Investment Limited, CA, No 248 of 2020.

This case talks about two main issue as law of limitation act concerns as well as issue of time limit of filling objection proceeding as civil procedure in Tanzania concern.

The court has this to hold:

1. In terms of the provisions of *section 4 the Law of Limitation Act, Cap. 89* of the Laws of Tanzania, the period of limitation in relation to any proceeding commences from the date on which the right of action for such proceeding accrues. Likewise, by virtue of *section 5 of the same Act*, the right of action in respect of any proceeding, accrues on the date on which the cause of action arises. 

2. The provisions of *Order XXI rule 57 of the CPC* which governs objection proceedings does not prescribe any time limit within which to file such applications.
