NOTICE TO RELY ON SECONDARY EVIDENCE

(Made under Section 68(d) and 67 (1) (a) (i)(c)(2) of The Evidence Act [CAP 6 R.E. 2019])

TAKE NOTICE THAT; during the hearing of this suit, the plaintiff shall rely on secondary evidence to prove his case on the ground that, the original documents are in possession of the person against whom the documents are sought to be proved, some have been lost and other reasons to be advanced during the hearing. Copies of the following documents will be relied on:

All Lease agreements with their extensions executed by parties from 2010 to 2021 

Demand notice sent to plaintiff for payment of outstanding rental dated 7th October 2021

Written statement of defense filed by defendant before the District Land and Housing Tribunal for Temeke at Temeke

Printed defendant’s WhatsApp Messages sent to Plaintiff requesting and acknowledging for payment of money from plaintiff.
